The dirty names are because you promised when you received the software
to honor certain conditions. Now you are bringing in a third party
which has no part in this transaction, some group of men that uses guns
to collect taxes and calls itself a government, and claiming that the
words of those men mean that you no longer have to honor your promises.
What do they have to do with it? This transaction is between two
parties, the seller and you, the buyer. How can a third party give you
the moral right to break your word to someone else? They cannot. Is a
man no longer a liar because a government proclaims him to be honest?
It has no such power.

They come from the very beginning as far as the legal validity of that
contract is concerned. They are there to protect the rights of each party
in the case of one party reniging on the contract. Without them, as
many libertarians refuse to admit honestly, there is no way to enforce the
contract short of the abriged contract holder resorting to violence or
subterfuge.
Neither of these are acceptable solutions to a disagreement in a civilized
society.
