What makes you think that one must agree to honor the software when one buys
it?  I sure don't make any such agreements when I buy software.

If you're paying for the software, and not stealing it, then the exchange
of your goods/services (i.e. money) for having a physical representation
of that work and the right to use it is in fact a contract. Implied yes,
but still a contract.
